RESOLUTION NUMBER 2023-03 HIGHWAY CLOSURE WHEREAS, the DeWitt Civic Board will be hosting the 4th of July Celebration on Saturday, July 1, 2023; WHEREAS, the DeWitt Civic Board has requested that HWY 103 be closed from N. Hawthorne Street to W. Railroad Street, between 9:30 p.m. and 10:30 p.m.; WHEREAS, closure of a State Highway for a special event requires notification to the Nebraska Department of Roads and the City’s agreement to indemnify the State. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE BOARD OF THE VILLAGE OF DEWITT, NEBRASKA: SECTION 1. That the Village of DeWitt council desires to allow DeWitt Civic Board to utilize HWY 103 from N. Hawthorne St. to W. Railroad Street, between 9:30 p.m. and 10:30 p.m. on Saturday, July 1, 2023 for the 4th of July Celebration. SECTION 2. That the Village of DeWitt acknowledges and accepts the duties set out in Neb. Rev. Stat. §39-1359(2)(d) and, if a claim is made against the State, shall indemnify, defend, and hold harmless the State from all claims, demands, actions, damages, and liability, including reasonable attorney’s fees, that may arise as a result of the special event. SECTION 3. That all resolutions or parts of resolutions in conflict herewith are hereby repealed.
