NOTICE TO DEFENDANTS TO: Defendants the Estate of Zdenka Solc, the Heirs, Legatees, Devisees, Personal Representatives, and All Other Persons Interested in the Estate of Zdenka Solc, Deceased, real names unknown, Spouse of Zdenka Solc, real name unknown, and Spouse of Bohumil A. Solc, real name unknown. Notice is hereby given that on the 15th day of April, 2014, OneWest Bank N.A., as the plaintiff, filed its Complaint in the District Court of Saline County, Nebraska, Case No. CI 14-71, against the Estate of Zdenka Solc, the Heirs, Legatees, Devisees, Personal Representatives, and All Other Persons Interested in the Estate of Zdenka Solc, Deceased, real names unknown, Spouse of Zdenka Solc, real name unknown, Spouse of Bohumil A. Solc, real name unknown, Ben Scholz a/k/a Ben A. Scholz f/k/a Ben A. Solc, Alicia Sholz, the United States of America, by and through the Secretary of Housing and Urban Development, Beneficiary, and Stewart Title Guaranty Company, Trustee, the object and prayer of which is to quiet title and to foreclose a certain deed of trust in the principal amount equal to the sum of all loan advances made under a Home Equity Conversion Loan Agreement on the property described as: Part of the Northwest 1/4 of the Northeast 1/4 of Section 22, Township 6 North, Range 4 East of the 6th P.M. in Saline County, Nebraska; more particularly described as follows: Commencing at a point 461 feet South of the Southwest corner of Lot number 359 in the original town of Wilber, Saline County, Nebraska; thence running 142 feet East, thence 122 feet South, thence 142 feet West, thence 122 feet North to the place of beginning, and beginning at a point 461 feet South of the Southwest corner of said Lot 359 in the original town of Wilber, Nebraska and 142 feet East thereof, thence running South 87 feet, thence East 32 feet, thence North 87 feet, thence West 32 feet to the place of beginning, which was executed on October 25, 2004, by said Zdenka Solc, and delivered to Stewart Title Guaranty Company, as Trustee, for the benefit of Financial Freedom Senior Funding Corporation, a Subsidiary of Indy Mac Bank, F.S.B., Beneficiary, and which was duly recorded on November 10, 2004, in Book 334 at Page 212 of the Official Records in the Office of the Register of Deeds of Saline County, Nebraska. Such deed of trust was given to secure the payment of a certain promissory note in writing dated October 25, 2004. The plaintiff alleges in its Complaint that there is now due the plaintiff on said note the principal sum of $66,710.25, together with interest thereon pursuant to terms set forth in such note. The plaintiff is the owner of the beneficial interest under such deed of trust, and is the holder of the indebtedness secured thereby. The plaintiff prays that in default of payment by the defendants of the amount due the plaintiff as aforesaid, such mortgaged premises be decreed to be sold according to law to satisfy the sums found due the plaintiff, with interest and costs of suit, and that such defendants be forever barred and foreclosed of all right, title, lien, equity of redemption or other interest in, to and upon such mortgaged premises.
